Former Rexburg, Idaho elk rancher, Rex Rammell, has filed a tort claim in court against the state of Idaho listing the Idaho Department of Fish and Game, the Department of Agriculture and governor’s office as defendants. He is seeking $1.3 million in damages claiming the government was negligent and capricious in ordering a hunt of his escaped elk.

Last August, after some of Rammell’s elk got out of his enclosures, then Idaho Govenor Jim Risch ordered all of Rammell’s elk found outside his enclosures killed on sight.

Nobody has ever official said the exact number of elk that escaped and the exact number that were recapture. Nor has Rammell or the state ever said how many of his elk were shot by the state sponsored hunt.

All of the killed elk were tested for disease and genetic purity. All animals were clean and pure.
