Texas billionaire Dan Duncan, who has been under investigation by a federal grand jury on possible charges of violation of the Lacey Act (pdf), has been cleared of any charges. This investigation surrounds a hunting trip to the Siberian region of Russia for moose and sheep. His guide for that trip, Robert Kern of the Hunting Consortium in Berryville, Virginia, has been charged with one count of violation of the Lacey Act, which prohibits the importation of antlers from illegally shot game. This is his charge.
Duncan maintained at the onset of the grand jury investigation that he did hunt from a flying helicopter but that he wasn’t aware that it was illegal.
Robert Kern’s lawyer, Tim Heaphy, says that his client is not guilty of these charges and will fight it.
