		<description>One correction is necessary.  The bald eagle was delisted by the federal government and is no longer on the endangered species list.  In Maine, however, the bird remains on the State&#039;s endangered species list for at least the time being.  Specific regulations then, such as the Essential Habitat Rule, remain in effect (requires Maine Department of Inland Fisheries &amp; Wildlife review and approval of any project which requires either a state or municipal permit, or is partially or wholly state funded, and the partially or wholly lies within 1/4 mile of a designated &quot;Essential Habitat&quot; (bald eagle nest).  If and when the legislature delists the bald eagle, this rule will sunset.</description>

I absolutely agree that the ESA, as well as several other major environmental and conservation acts are being wildly abused.  It&#039;s the leverage of the ESA that is driving the lead-ban issue here in CA, and while I agree that lead ammo should be phased out, I disagree with doing it in the name of a bird that no longer has an environmental niche to fill.  

Point is, the ESA has a good purpose.  The problem is that we (the people) have allowed a vocal minority to take it over and use it for their own purposes.  

Personally, though, I believe this one is nicely tied to your &quot;Stupid People&quot; post above...  if folks had (or exercised) any common sense, none of this would have been allowed to happen.  Unfortunately, the majority of people (voters) falls into this category and I have very little hope of ever seeing it change.  

Most people are sheep, poorly suited for true democracy.  Fact, fiction, sense, or nonsense don&#039;t matter.  They can be led by anyone with a crooked stick, especially if the &quot;shepherd&quot; has a good dog nipping at their heels.  The only hope is that there are enough people with some sense of their own to put new shepherd out there, and drive the herd in the right direction.</description>

On the contrary. What I&#039;m really saying is this ESA is going on 35 years old and has gotten to the point where it is twisted and bent out of shape while being abused and taken advantage of.

It has used up his life and needs some serious attention in two major areas. One is how it is determined when a species should be protected and find a way to reduce the years and millions of dollars tax payers are having to spend to fight ridiculous law suits. 

I believe in due process but it is now out of control.</description>
