This morning the Washington Times is reporting that the United States Supreme Court has postponed a decision on whether or not they will hear the appeal of the Washington, D.C. gun ban that recently a lower court ruled as unconstitutional. All eyes and ears were on SCOTUS yesterday waiting to hear whether the court would hear a Second Amendment case since 1939. With no explanation, the High Court decided to postpone that decision. The next possible announcement would come on November 26.
The Times gives a few speculative reasons why SCOTUS may have put this off.
The justices generally announce the disposition of cases they have considered on an orders list the following week, but no mention of the gun-ban petitions was on the list yesterday.
Jerome A. Barron, a professor at George Washington University Law School in Northwest, said the justices may have wanted more time to discuss the case in conference.
He also speculated that the court could be waiting on the opinion of one justice, or be allowing a justice to write a dissenting opinion to their decision.Others have said the justices may be attempting to further define the aspects of the case they will consider.
“It could be any number of reasons,” Mr. Barron said. “It’s anybody’s guess why they haven’t acted on it.”
So, we now wait some more and see what happens.
