McCain signs, Obama and Clinton leave names off.

Seal of the United States Supreme CourtIn what appears to me to be a very quiet issue among presidential candidates vying for their party’s nomination, support for a ruling in favor of an individual right to keep and bear arms mounts. Not that I have been a listener of every debate or round table discussion with these candidates, but I have yet to hear one question posed to the candidates about their position on the Washington, D.C. gun ban case.

District of Columbia vs. Heller, a case in which a Washington, D.C. security guard et. al., challenged the District’s law banning the possession of hand guns and its restrictions on other gun ownership, claiming it to be unconstitutional. That challenge was upheld in a District Court last year and the United States Supreme Court has agreed to hear this case, setting the stage for what could be one of the deciding factors in the race for the White House.

While this ruling by the Supreme Court could be the biggest on having the most societal impact in decades, it has remained basically non existent so far during this campaign period. It can’t remain this way forever and that began to show this past week when members of Congress filed their own brief(pdf) asking the High Court to rule in favor of upholding the lower court’s ruling.

There have been many briefs filed in this case, the latest being this one signed by 55 U.S. Senators and 250 Representatives. I will post below a complete listing of who signed on to this brief.

There are couple things that should be noted. The first is that Vice President Dick Cheney is showing opposition to the President’s brief filed earlier this year by his Solicitor General Paul Clement.

The White House’s brief stated that the Supreme Court should return the case back to the lower court for further debate and clarifications on some points, specifically defining the government’s right to restrict and control guns. This, of course, set off quite a fire storm among gun rights believers.

According to the Washington Post, Cheney signed the brief because he can as President of the U.S. Senate and because he is a strong believer in the individual right to keep and bear arms. A Bush spokesman, Tony Fratto, spent time focusing on the agreements between Bush and Cheney on this issue.

“Like the members of Congress who signed the amicus brief, the president strongly believes that the Constitution protects an individual right to keep and bear firearms,” Fratto said.

“The president leaves procedural questions to the lawyers. What’s most important is that this administration firmly supports the individual-rights interpretation of the Second Amendment.”

The second issue that needs pointing out is that while it is good that so many members of Congress have signed onto this brief, not all of these signing on are strong supporters of the Second Amendment. As a matter of fact, I think it would be safe to say that the vast majority believe in some kind of gun control and restrictions of ownership. Also remember this is an election year and often politicians scramble to muddled their records and change their spots in order to appear to be not opposed to gun rights, a stand that has sent many a politician packing.
