Because the judges, in this case all three, don't understand what a DPS is, it's illegal. One judge actually said he couldn't accept a DPS because he could find it used in science. Probably back in 1973 the law makers might have had thoughts that those fish and game people probably could figure this out and make it work. Well, maybe so but not anymore. It matters not how much and how loud we scream for the need of ESA reform, if falls on deaf ears or at least on ears so filled with anti-hunting garbage they just aren't hearing the rest of us..........yet.
